These Terms of Service (“Terms”) govern your access to and use of the website located at www.inkygoodness.com (the “Site”), operated by Inkygoodness Limited (“Inkygoodness”, “we”, “us”, “our”), and any related services, products, memberships, courses, content, or applications offered by us (collectively, the “Services”).

By accessing the Site, creating an account, purchasing Products or Services, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy [Link to Privacy Policy], which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Site or our Services.

Use License (Website Materials) Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal, non-commercial use of the materials (information, text, graphics, software) on the site. This license does not allow you to:

  • Security: You are responsible for safeguarding your account password and for any activities or actions under your account. Notify us immediately of any unauthorised use.  

  • Account Termination: We reserve the right to suspend or terminate your account if you breach these Terms or engage in activity that is harmful to us or others.

  1. User Conduct and Prohibited Activities You agree not to use the Site or Services to:

  • Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable;  

  • Impersonate any person or entity or falsely state or misrepresent your affiliation;

  • Infringe upon any patent, trademark, trade secret, copyright, or other proprietary rights of any party;  

  • Transmit unsolicited advertising, promotional materials, “junk mail,” “spam,” or any other form of solicitation;

  • Transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;  

  • Interfere with or disrupt the Site, Services, servers, or networks connected to the Site.  

  1. Intellectual Property Rights All content included on the Site and within the Services, such as text, graphics, logos, images, audio clips, video, data, software, and other material (collectively “Content”) is the property of Inkygoodness or its content suppliers and protected by UK and international copyright, trademark, and other intellectual property laws. The Inkygoodness name and logo are trademarks of Inkygoodness. You may not use our trademarks without our prior written permission.

  2. Purchases, Payments, and Orders (Products, Memberships, Courses)

  • Order Acceptance: Placing an order constitutes an offer to purchase. All orders are subject to acceptance by us. We will confirm acceptance by sending you an order confirmation email. The contract between us will only be formed when we send this confirmation. We reserve the right to refuse any order.  

  • Pricing: Prices for Products and Services are listed on the Site and are inclusive of VAT (where applicable) at the current rate unless otherwise stated. Prices are subject to change without notice. Delivery costs will be added where applicable.

  • Payment: Payment must be made at the time of order using the payment methods specified on the Site (e.g., credit/debit card via [Specify Processor like Stripe/PayPal]). You confirm that the payment method used is yours or that you have authorisation to use it. Payments are processed securely by our third-party payment processors.

  • Specific Terms: Additional terms may apply to specific purchases, such as course access duration, membership benefits and renewals, or digital product licenses. These will be presented to you before you complete your purchase.

  1. Delivery (Physical Products)

  • Shipping: We will arrange for the delivery of physical products to the address specified in your order.

  • Costs & Timescales: Delivery costs and estimated timescales will be specified during the checkout process. While we aim to meet estimated delivery dates, these are not guaranteed.

  • Risk: Risk of loss or damage to the products passes to you upon delivery.

  1. Cancellations, Returns, and Refunds (Consumer Rights) This section applies primarily to consumers purchasing Goods or Services online. Your statutory rights are not affected.

  • Cooling-Off Period (Consumer Contracts Regulations 2013)

    • Physical Goods: You have the right to cancel your order for physical goods within 14 days after the day you receive the goods, without giving any reason. You must inform us of your decision to cancel (e.g., via email) and return the goods to us within 14 days of notifying us. You are responsible for return shipping costs unless the goods are faulty. We will refund the price paid for the goods and standard delivery costs within 14 days of receiving the returned goods or proof of postage. Refunds may be reduced if the value of the goods has diminished due to handling beyond what is necessary to establish their nature, characteristics, and functioning.  

    • Digital Content (e.g., downloadable courses, e-books): Your right to cancel within 14 days is lost if you expressly consent to the supply beginning before the end of the cancellation period and acknowledge that your right to cancel will be lost. We will typically seek this consent before you download or access the content.

    • Services (e.g., ongoing memberships, timed courses): You have the right to cancel within 14 days after the day the contract is made. If you request the service to begin during the cancellation period, you must pay us an amount proportional to what has been supplied until you communicated your cancellation, compared to the full contract coverage.

    • Exceptions: The right to cancel does not apply to certain items, such as personalised goods or sealed items unsuitable for return if unsealed (e.g., hygiene reasons).

  • Faulty Goods (Consumer Rights Act 2015)

    • If goods are faulty, not as described, or unfit for purpose, you have statutory rights. Within 30 days of receipt, you are entitled to a full refund. After 30 days (up to 6 months), you are entitled to a repair or replacement; if that is not possible or fails, then a full refund in most cases. Similar rights apply to digital content and services not being of satisfactory quality or fit for purpose. Please contact us promptly if you believe an item is faulty.

  • Subject to the above, Inkygoodness and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services; (c) any content obtained from the Services; or (d) unauthorized access, use, or alteration of your transmissions or content.  

  • Subject to the above, our total liability to you in respect of all other losses arising under or in connection with the contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the total price of the Products/Services paid by you under the relevant order/contract.  

  • Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any goods or services to you, which will be set out in relation to those specific goods/services where applicable.

Indemnification You agree to defend, indemnify, and hold harmless Inkygoodness, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site or Services, or your violation of these Terms.

Inkygoodness has not reviewed all of these sites and is not responsible for the content, products, or services on or available from those websites or resources. Governing Law and Jurisdiction These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms or their subject matter or formation. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.  

  7. Dispute Resolution If you are a consumer, please note that disputes may be submitted for online resolution to the European Commission Online Dispute Resolution platform available at [Provide Link – https://ec.europa.eu/consumers/odr]. We do not commit to using an ADR procedure.  

  8. General Provisions

  • Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. 

  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Inkygoodness regarding our Services and supersede and replace any prior agreements we might have had.

  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
